Condition of sale
The purchase and sale of products and services via electronic means is governed by Legislative Decree 6 September 2005 n. 206 (Consumer Code) regarding remote sales with consumers, and by Legislative Decree 9 April 2003 n. 70 on electronic commerce.
The purchase contract stipulated between the Customer and Padel M2 SRL (hereinafter referred to as Padel M2) will be governed and interpreted in accordance with Italian law.
ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
By placing an order according to the various methods provided on the Site, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general conditions of sale and payment transcribed below.
These general conditions of sale, together with the conditions concerning the methods of delivery and payment of the goods, form an integral part of the purchase contract concluded between the Customer and Padel M2.
Therefore Padel M2 invites you to carefully read these general conditions of sale, to print them or in any case to save or keep an electronic copy in compliance with the provisions of art. 3 and 4 of Legislative Decree n. 185/1999 on distance selling.
HOW TO PURCHASE
The Customer can purchase the products present in the Padel M2 electronic catalog at the address www.born2padel.com at the time of placing the order illustrated on the homepage of the Site, within the respective sections by product category, as described in the related information sheets provided by the manufacturer.
The products published on the site can be:
"available" physically in the warehouse and therefore, as such, orderable by the Customer; "not available" physically not available in the warehouse. In this case the product cannot be ordered by the Customer, who can enter his email address in the appropriate form on the product page to be notified if the product becomes available again.
Padel M2 reserves the right not to complete the order without assuming any responsibility and without this resulting in any obligation to compensate the buyer. In the event of non-acceptance of the order, Padel M2 undertakes to promptly notify the Customer.
Padel M2's acceptance of the order is confirmed by sending a confirmation email to the email address communicated by the Customer at the time of purchase.
This confirmation message will contain:

The Customer who undertakes to verify the correctness of the data in the order confirmation email and to promptly report any errors or omissions to Padel M2.
Since the simultaneous access of many user-customers and the simultaneous possibility of 'online' orders change the availability of the product, Padel M2 does not guarantee the certainty of assignment of the ordered goods, the actual availability of the product can only be evaluated at the moment of the actual taking charge of the order which is a moment after its acceptance.
If the Customer is registered on the Website www.mainpadel.com, he will be able to check the status of his order by accessing the web area dedicated to him.
The sales prices of the products published on the Site are inclusive of VAT.
Padel M2 reserves the right to change the prices at any time, but equally undertakes to apply the prices indicated on the Site at the time the order is placed.
In case of displaying an incorrect and/or manifestly negligible price, for whatever reason (computer bug, manual error, technical error, etc.), the order will be cancelled, even in the case of initial validation.
TERMS OF PAYMENT
Purchases made on the www.born2padel.com website are safe and guaranteed.
Currently it is possible to opt for the following payment methods:
The main credit cards and prepaid cards belonging to the Visa, MasterCard, Maestro, American Express, Discover, Carta Aura circuits are accepted.
In cases of purchase by credit card, SEFHT will only authorize the debit of the amount relating to the purchase made. If you change your mind and decide to cancel the order or in case of non-acceptance of the contract on our part, we will ask you to cancel the transaction and you will be refunded the committed amount.
Once the transaction has been cancelled, we cannot in any case be held responsible for delays and/or damages caused by the banking system.
Padel M2 accepts orders only with delivery in the territory of the Italian state.
For all orders over € 100.00 shipping is free. For those whose amount is less than € 100.00 the shipping cost is € 8.00.
In the event of a total return of the order, the standard shipping cost will be refunded.
For most of the products in our catalog, the average delivery time is 3 working days.
The same may undergo variations due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority. Furthermore, the times stated above may vary during high season and/or holidays.
Any external damage or the mismatch in the number of packages must be immediately reported to the courier who carries out the delivery, adding the wording "withdrawal with reserve" on the appropriate accompanying document. Furthermore, the opening of an anomaly file at Padel M2 must be requested, by sending an e-mail to firstname.lastname@example.org or by contacting customer service on the number .
Once the courier's document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered.
RIGHT OF WITHDRAWAL
Sales of products via the Internet are governed by articles 50 to 68 ("distance contracts") of Legislative Decree 206/2005 (Consumer Code). This legislation provides for the consumer the right to withdraw from contracts or contractual proposals without the need to specify the reasons, guaranteeing him the right to return the purchased product and to obtain reimbursement of the expenses incurred.
The request for withdrawal must be made no later than 14 days from the date of delivery of the order. In order to enjoy the right of withdrawal, the product must be returned in the same condition in which it was received, therefore complete with any packaging, seals, labels, various accessories supplied. We will not be able to accept the return of products that do not comply with these conditions; in this case the package will be returned to the sender with the transport costs charged and the refund will not be made. This inconsistency will be immediately notified by email to the Customer.
It is not possible to exercise the right of withdrawal in the following cases:
in the absence of the original packaging (including the manufacturer's seals where present); in the absence of integral elements of the product (accessories, etc.); for damage to the product; for products that show signs of tampering, abrasion, wear or dirt.
The right of withdrawal is reserved exclusively for consumers (natural persons who purchase the goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal persons and natural persons who purchase for purposes related to their business and who therefore communicate their VAT number to Padel M2.
HOW TO EXERCISE THE RIGHT OF WITHDRAWAL
The right of withdrawal is exercised, within the term indicated above, via the online procedure on this page .
Following receipt of the request in which the Customer communicates his willingness to exercise the right of withdrawal, Born2Padel will send the Customer confirmation of approval of the withdrawal request via email with the guidelines for sending the product. The Customer undertakes to return the products no later than 14 days from receipt of the email confirming the approval of the request for withdrawal.
REQUIREMENTS NECESSARY TO MAKE THE RETURN
All products returned in order to obtain a refund must retain the characteristics they had at the time of purchase and all original seals, labels, boxes or wrappings must be intact. In the absence of this requirement, the product will be considered "used" and will therefore be returned to the sender with transport costs charged and the refund will not be made. This inconsistency will be immediately notified by email to the Customer.
Rackets : rackets must not be used, must not show scratches, imperfections, marks and must not have undergone any alteration such as shrinkage applications or accessories such as overgrips, tape, etc. The plastic wrap on the handle must be intact and never removed.
Clothing : Must be returned complete with original packaging and with all manufacturer tags unremoved. The item must be returned in perfect condition, never worn, never washed and without marks, stains or alterations.
Bags, accessories : the original labels and packaging must be intact and never opened.
Balls : Pressurized tubes must be returned intact, never opened and without written marks or dents.
Returns are considered "Authorised" only and only if they bear the specific Return Label that the Customer receives after making the request for withdrawal. All returns that will reach us without the Return Label and therefore without authorization will be systematically refused by our warehouse.
METHODS AND TIMES FOR REFUND
Once Padel M2 has received the returned product and checked its condition, it will refund within 14 days.
For purchases made by paying by credit card, the refund will be made by reversing the transaction directly to the credit card.
Pursuant to Legislative Decree 206/2005 ("Consumer Code") all products on sale on this site are covered by the Legal Guarantee.
Based on the 24-month Legal Guarantee, Padel M2 is liable to the consumer (the natural person who acts for purposes unrelated to any business, commercial, craft or professional activity carried out) for any lack of conformity that cannot be detected at the time of purchase .
The lack of conformity exists when the product is not suitable for the use for which it is intended, does not conform to the description or does not possess the qualities promised by the seller and typical of the product sold, does not offer the usual qualities and performance of a product of the same type, is not suitable for the particular use desired by the Customer if brought to the attention of the seller at the time of purchase and accepted by the seller (Article 129 of the Consumer Code).
The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within 2 months from the date of discovery of the defect.
Unless proven otherwise, it is assumed that the lack of conformity which occurs within 6 months of delivery of the goods already existed on that date. In the event of a lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement (Article 130 of the Consumer Code). The consumer can ask, at his choice, the seller to repair the goods or to replace them, free of charge in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to the other. Repairs or replacements must be carried out within a reasonable period of the Consumer's request; the average delivery time to the consumer is 30 days. If within the maximum period of 60 days Padel M2 is unable to return the repaired product, the consumer may request one of the alternative remedies (replacement, termination of the contract, price reduction).
TIMES AND METHODS FOR EXERCISING THE LEGAL GUARANTEE
The Client must:
report any problem and/or alleged defect to Padel M2 within 2 months of discovering the same, by sending a communication via e-mail to email@example.com indicating the defect in the product; wait for Padel M2 to confirm the opening of the file together with the instructions for sending the product; prepare the product for shipment by packing it carefully and enclosing all accessories and everything originally contained in the product packaging; arrange for shipment within 10 working days of receipt of confirmation of opening of the file at the address "Padel M2 - Corso Casale 132/B 10132, Turin (TO)".
The costs and risks of transport for the return are fully borne by the Customer, who will be able to arrange for the shipment of the product only and exclusively by courier.
The return of products that are damaged, deteriorated or lacking original accessories and equipment will not be accepted by Padel M2 and will be returned to the sender with additional transport costs.
In the event of forfeiture of the right of withdrawal, Padel M2 will return the purchased good to the sender, charging the shipping costs to the sender.
All products distributed by Padel M2, in addition to being covered by the Legal Guarantee, are covered by the Manufacturer's Guarantee in the terms indicated by the Law.
Duration, territorial extension and methods for asserting this guarantee can be consulted by telephone on the number . No damage can be requested from Padel M2 for any delays in carrying out repairs or replacements of products under conventional warranty.
For the resolution of any civil disputes deriving from the interpretation, execution and termination of this remote sales contract, if the Customer is a consumer (i.e. a natural person who purchases the products not for purposes related to his professional activity) the territorial jurisdiction mandatory is the judge of the place of residence or domicile of the consumer himself, if located in Italy (Art. 63 Legislative Decree 205/2006).
These general conditions of sale will remain valid and effective until they are modified and/or supplemented by Padel M2.
Any changes and/or additions will be effective from the date of publication of the same on the website www.born2padel.com
